Thank you for considering Max Air HVAC for your heating, ventilation, and air conditioning needs. Please carefully read and understand the following terms and conditions governing our services. By using our website or availing our services, you agree to comply with these terms.

1. Services Offered:

Max Air HVAC provides an array of heating, ventilation (indoor air quality), and air conditioning services, including installation, replacement, conversion, repair, and maintenance.

All services are subject to the terms outlined in the service agreement between Max Air HVAC and the customer.

2. Services Not Offered:
​​​

New construction bidding or estimating based on the architectural plans unless the construction is at the stage ready for the HVAC system installation.

Radiant heating or cooling services.
-
Portable equipment services.
-
Services of the equipment installed on mobile units such as RVs, cars, trailers, etc.

Service of the patio heaters.
-
Service of commercial HVAC equipment with a capacity higher than 10 tons.

Sale of parts, equipment, or materials to the public, outside of the service.

4. Service Appointment:
​

Service appointments are scheduled based on availability and are subject to change in case of emergencies or unforeseen circumstances.

Existing customers have the priority over the new customers.

Max Air HVAC reserves the right to refuse services to anyone without explanation.

5. Pricing and Payments:

Pricing for services is outlined in the service agreement.
-
Payments are due upon completion of services unless otherwise specified in writing.

All estimates expire after 90 days and are subject to a price change.

The customer is responsible for returned check fees.

Max Air HVAC generally does not collect the deposits to schedule the service. Big and multi-stage projects are subject to prorated payments after completion of each stage.

Upfront payment may be required for special order items such as coastal coatings applications and custom-made parts.

Accepted forms of payment: Cash; Personal, Business and Cashiers Checks, Money Orders, All Major Debit and Credit Cards, Zelle Transfer.

6. Cancellation and Rescheduling:

Cancellation or rescheduling of service appointments should be communicated at least 24 hours in advance.

7. Warranty and Guarantees:
​​
Max Air HVAC provides warranties on parts and services as specified in the service agreement.
Guarantees are subject to proper use and maintenance of HVAC systems.
8. Customer Responsibilities:

Customers are responsible for providing unobstructed access to their HVAC systems during the service.

Unless the customer has signed up for a preventative maintenance service plan, the routine maintenance of the HVAC equipment is the customer's responsibility.

The customer is responsible for being present at the beginning and end of the service to provide signatures and render the payment unless agreed otherwise in writing.

The customer is responsible for being present at the service address during the arrival window hours unless agreed otherwise in writing.
9. Privacy Policy:

10. Intellectual Property:
All content on the Max Air HVAC website, including text, images, and logos, is the property of Max Air HVAC and may not be used without permission.
11. Mechanics Lien Rights
​
In accordance with California law, the contractor, subcontractors, suppliers, and laborers who provide work or materials to your project are entitled to file a mechanics lien against your property if payment for their work or materials is not received. The following terms apply:

Notice of Right to Lien: You are hereby notified that those who provide labor, services, equipment, or materials to your construction project have lien rights against your property if payment is not made in full. This includes the general contractor, subcontractors, laborers, material suppliers, and equipment lessors who have contributed to the project.

Preliminary Notice: As required by California law, subcontractors, material suppliers, and laborers who are not in a direct contractual relationship with the property owner must provide a written preliminary notice within 20 days of starting work or supplying materials to preserve their right to record a mechanics lien.

Right to Lien: If payments for any work, services, or materials are not made as agreed upon in the contract, the contractor reserves the right to file a mechanics lien on the property. Filing a mechanics lien allows the contractor or any authorized party to secure payment by making a claim on the property.

Release of Lien: Once full payment is received for all outstanding work, services, and materials, the contractor will promptly file a release of the mechanic's lien, removing any claim against the property.

Owner's Responsibility: It is the property owner's responsibility to ensure that all parties involved in the construction project are paid in full, as the property may be subject to liens by subcontractors or suppliers even if the owner has made full payment to the general contractor.

Dispute Resolution: In the event of a dispute over payment, the property owner and contractor agree to attempt to resolve the matter through mediation or arbitration before the filing of any mechanics lien, unless otherwise prohibited by law.

Lien Waivers: The contractor may provide lien waivers upon receiving progress payments or final payment, as agreed upon in the contract. The property owner may request partial or conditional lien waivers during the course of the project.

12. Dispute Resolution:
Any disputes arising from the services provided by Max Air HVAC will be resolved through mediation or arbitration in accordance with the laws of the state of California.
13. Changes to Terms and Conditions:
Max Air HVAC reserves the right to update these terms and conditions without notifying the customers. The latest update date will be recorded in the top portion of the page.
